September 13, 2004

Sutton, Charles – Beartown Mountain Road                        Map 4, Lot 15B
NOI 230-223 – Construction of a gravel driveway to access single-family dwelling
Order of Conditions Issued
(Hearing continued from August 9, 2004.)  Applicant wishes to construct a gravel driveway to access a single-family dwelling site.  A portion of the driveway is within the riverfront area and will cross bordering vegetated wetlands.  New plans dated September 10, 2004 were presented showing the installation of swales and rip rap along the driveway to divert water into the Town’s drainage system, and the installation of two catch basins on each side of the end of the driveway.   A driveway permit was issued by the Town’s issuing authority and presented at the hearing.  Installation of silt fencing was indicated on the new plan and its placement approved.  The Order of Conditions was issued with the following conditions:  1) Applicant shall contact the project manager at least 48 hours prior to commencement of the project; 2) Perpetual inspection, cleaning, and maintenance of catch basins shall be performed by the Owner; 3) Engineer shall provide a vegetation survival report on the condition of the replicated wetlands at the end of the first year’s growing season, and a final report two years after the first replication report.  The hearing was adjourned at 6:20 p.m.

Rauch, June – Bidwell Road                                      Map 14, Lot 87
June Rauch was present to discuss her project on Bidwell Road, lakeside.  Chris Blair, Chair for the Commission performed a site visit on Saturday, Sept. 11 after receiving violation complaints relating to work on the Ruach’s Bidwell Road property.  Owners are in the process of installing a driveway and parking area on the lot.  Mr. Blair noted discrepancies in the actual distances from the distances Owner indicated on their drawing of the project.  The Commission issued an Enforcement Order for disturbance and filling of the buffer zone of Lake Garfield.  To prevent further violation of the Act, the Owner was asked to 1) stop work; 2) install hay bales and stake then at 100 foot intervals from the bank; 3) File an RDA and show how much buffer zone is disturbed; 4) submit a plan showing sufficient drainage to demonstrate runoff water management and control.

Continued to October 11, 2004 meeting
(Hearing continued from August 9, 2004.)  The hearing commenced at 6:45 p.m., and was continued to the October 11, 2004 meeting.  No new plans were issued.  John Sylbert was present to discuss problems with the new location of the house with respect to streams and wetlands located on the property not indicated on the plans.

The Commission reviewed revised plans prepared by Carey Associates dated August 6, 2004.  The Commission indicated that from the local standpoint, the reserve area poses a problem due to its location of 75’ into the no build zone from the bank of Lake Garfield.  Paul Carey, P.E. asked in his letter of August 12, that the file remain open until such time as Applicant retrieves all required permitting from the local boards.


The Commission reviewed mail, and asked the Clerk to revise the Scenic Mountain Act forms for applicants to use.

The Commission reviewed the Scenic Mountain Act prior to registering.

The Hearing was adjourned at 9:35 p.m.
